He also wishes and grants that all barons and free-holders of the earldom, who held from the king and his predecessors in chief, should do homage, fidelity, suit of court and all other services to Thomas and his heirs, and they should hold their baronies and tenements from him and his heirs. The king reserves the rights and liberties of his court from the barons and free-holders, which hitherto were justly customary. Additionally, he wills and grants that the burghs and his burgesses of Elgin, Forres and Invernairn should have the same liberties as they held in the time of Alexander [III], king of Scotland, and in the time of King Robert himself. He reserves that they will hold this alone from the king, without intermediary, and he states that at the present they hold it from the earl with the same liberties. The king reserves his burgh of Inverness, with the local castle and the lands pertaining to the burgh, with the fishing of the River Ness and with the mill of the burgh, etc. He reserves to himself the fealty of the bishops, abbots, priors and other prelates of the church of Moray, and the advowsons or rights of patronage of the churches, etc. which they held in the time of King Alexander [III] and his other predecessors of the kingdom of Scotland. He states that the men who could be mustered by him for the defence of his kingdom should come under the banner of Earl Thomas and his heirs, along with the others which formerly used to follow the banner of Moray.
