Translation

To all who shall see or hear this letter, John de Ile, Count of Rossie and Lord of the Isles, eternal salvation in the Lord. You will know that we have given by consent and agreement and early deliberation of our whole council granted and confirmed by this present charter to our dearest brother Celestine de Insulis all and each of our lands underwritten namely our lands of Lochbryne Lochalsche Lochcarryn Torvirtayne and Kischem with appurtenances in our county of Rossie below the county of Winters. To hold and to have all and whole the aforesaid lands with their appurtenances to our aforesaid brother Celestine and his heirs between Celestine himself and Finvola Lachlan McGilleon de Dowart of his body lawfully begotten or to beget whom but failing that which is absent from the true lawful heirs of the said Celestine between Celestine himself and any other wife legitimately begotten or procreating whom all that is absent we want that all and each of the aforesaid lands to us and our heirs with their appurtenances as is prescribed freely without any question and clamor or interruption shall return from us and our heirs in an unfaithful and perpetual inheritance in all their rightful ancient goals and divided into plain woods, meadows, meadows, and marshes, pastures, and pastures, peters, turbarians, charcoal makers, and brats, roads, paths, ponds, streams, rivers, and lakes, forests, oaks, brambles, and bushes, hunting, hunting, fishermen, with le wrak waith, and ware, with mills, multitudes, and their sequels, with the courts and their exits. of herezelds of bludwite forks and women's merchandise with all pasture and children ingress and egress and with all other conveniences liberties fertility and assises and their just appurtenances to any tarn not named or named tarn under the ground and above the ground as near as far as the aforesaid lands with their appurtenances justly look to those who are strong in the future freely, quietly, fully, completely, honorably, and in peace, without any revocation or remonstrance. And we, the aforesaid Johannes count Rossie and lord of the Isles, our heirs and successors, the whole and entire aforesaid lands with their appurtenances to the aforesaid Celestine and his heirs between Celestine himself and the aforesaid Finvola, lawfully begotten or procreating, failing which, that which is absent from the true legitimate heirs of the said Celestine, between Celestine himself and whatever we will warrant another legitimate wife from his body begetting or begetting in all and by all things as is aforesaid against all mortal men and women we will appease and defend eternally. In witness whereof we have affixed our seal to this present charter. At our castle of Dingwele on the second day of February in the year of the Lord 1000 xxii.

comment: This and two later grants to Celestine (nos.80, 82) were confirmed by the king on a visit to the north in the summer of 1464, when much sorting out of the lord’s affairs took place. These lands were confirmed by James, duke of Ross, in February 1499/1500 to Donald of the Isles as heir to his father Alexander, son of Celestine; Donald died without issue in 1519 and his heirs were his sisters Janet who married William Dingwall of Kildun and Margaret who married Alexander MacDonald of Glengarry (see app. D, table 6/7 and 8). On 10 September 1524 two transumpts were made in the Cathedral of Ross of documents produced by William Dingwall of Kildun. The first apparently included four items - a version of this document including passages quoted above, another version similar to the Great Seal, a copy ofno.80, and a precept byJohn, lord of the Isles, to John Munro of Foulis on which Riddell’s notes do not give details oflands or date. The second transumpt dealt with the grant by the duke of Ross (Fraser, Cromartie, ii, 342). The lands were divided between the daughters, but by the end of the sixteenth century all had been acquired by the MacKenzies (J. Munro in The Ross and Cromarty Book, ed. D. Omand (Golspie, 1984), 134-5). We are grateful to Professor A. A. M. Duncan for drawing our attention to the relevant items in Riddell’s notes.
