Transcription

2658. 7th January 1670.] Instrument of Sasine following on a precept in a bond [dated at Kessock, 13th December 1669] by Hector Douglas of Mulderg in favour of John Polson of Merkinsh, in security of 4000 merks, of the two mills called the mills of Fearn, in the abbacy of Fearn and shire of Ross. Witnesses to bond, Alexander Fraser, Alexander Ross, Alexander Macintosh, and David Baillie, all writers in Inverness. Sasine given by the said David Baillie, 7th January, and recorded at Fortrose 16th February, 1670. Witnesses, Andrew Ros, brother to William Ros of Bellamouckie, Donald Sutherland, multerer, and Donald Sutherland, miller, at said mills, John Ros, mason in Bellindrom, William Sutherland, miller, and John Dunzein. Discussion

This sasine includes as a witness Andrew Ros, brother to William Ros of Bellamouckie. There is some question about the identity of this Andrew and his brother William. According to Rossiana, George, 5th of Balmachy, had sons Walter, Andrew, and David. Walter became the next laird of Balmachy after George's death in 1647. This sasine is dated 1670, 23 years later. Was Walter still laird of Balmachy at this point, but listed in this document as William? Or listed as Walter, but misread as William? Rossiana states that Andrew, son of George, is mentioned in 2 sasines, dated 1649 and 1658. And that Walter, son of George, is mentioned in sasines in 1647 and 1680. So, one of these is not correct. Either a William was laird of Balmachy in 1670 and Rossiana is mistaken that Walter is mentioned in a document in 1680. Or Walter was still laird of Balmachy in 1680 and either this recording or transcribing of William as laird of Balmachy in 1670 is in error.

We either have evidence that Andrew, son of George, was still living as late as 1670. Or we have evidence of another generation between Walter and Hugh.
